spouse or common-law partner cohabits (lives) with you in Canada and has temporary resident status.Your spouse or common-law partner can’t become a permanent resident in Canada if they’re inadmissible for any reason other than not having legal immigration status in Canada. A public policy also covers spouses and common-law partners who will be assessed for permanent residence even if they have no legal immigration status in Canada. Before applying, your spouse or common-law partner in Canada must resolve any other situation that made them inadmissible.

The Canada Dependent Visa allows you to bring your dependents to Canada and also allows them to work or study full time once they have the relevant permits. Under the Canada Dependent Visa, you can sponsor the following relations for a dependent visa:

The relations you sponsor can live with you in Canada. Your spouse or conjugal partner can also apply for a Work Permit in order to work in Canada.

Eligibility Criteria
  • At least 18 years old.
  • Your relationship is genuine (real) and wasn’t entered into just to get permanent resident status in Canada.
  • Should not involved in any criminal cases.
  • Should pass medical exam.
  • Has been living with you for at least 12 consecutive months, meaning you’ve been living together continuously for 1 year in a conjugal relationship, without any long periods apart.

How to Apply

There are several steps to complete the Spouse Visa application and they are listed and explained in detail below:

  • Confirm your eligibility for a Spouse Visa.
  • Compile the document file and application forms for a Canada Spouse visa.
  • Submit the Spouse Visa Application.
  • Wait for processing and respond to additional requests for information.
  • Send your passport for stamping.

Documents needed

For Applicant (who is going to apply visa)

  • Indian Passport (all pages)
  • Birth Certificate – Issued by birth registration authority where your name and parents name should be mentioned (In English).
  • Police Clearance Certificate (Original hard copy) - Police Clearance Certificates are required from all the countries where you have lived for 6 or more than 6 Months in last 10 year.
  • Two ID Photos
  • National Identity Document – Pan Card or Aadhar card.

For Children ( if applicable)

  • Indian Passport (all pages)
  • Birth Certificate – Issued by birth registration authority where your name and parents name should be mentioned (In English).
  • Two ID Photos
  • National Identity Document – Pan Card or Aadhar card.

For Sponsor (who got PR)

  • PR card or Citizenship Certificate.
  • Indian Passport / Canadian Passport – All stamped and Blank Pages.
  • Utility bills (Water, Electricity, mobile or rent agreement) – Recent 6 Months
  • Proof of Employment – Recently issued Original Experience certificate on company’s letterhead stating your period of employment, salary, and regular hour per week.
  • Notice of Assessment & T4 (Tax document) -
  • Bank statement (recent 6 months)

Proof of Relationship

  • Marriage certificate -Marriage certificate should be legally registered with government authorities.
  • Wedding, Roka, Sagan and Honeymoon Photographs. (5 photograph of each function) (Original hard copy) - With description of every event behind every photo (Maximum 20 Photos).
  • History of your relationship in word format. Sample attached.
  • Reference letter from friends (any four) – Please ensure that they sign them and provide their contact details. Sample attached.
  • Social Networking chats (like Facebook, Whatsapp, Email etc.) , must be in English (to be readable for visa officer)
  • Tickets, Boarding Passes of your travels that you took to meet each other.
  • Gifts exchange proofs with explanation (if any).
  • Employment beneficiary document of sponsor mentioning spouse as a beneficiary.
  • Bank statements where any of you have transferred funds to each other – to show that you are financially supporting each other.
  • Evidence of joint bank account (if any)

All the documents must be translated into English or French and you must have certifications and proof that the translation is correct. Once you submit all the documents, you can then proceed to submit the application and pay the fees.
